These following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant”) and an affiliate (“you” or “affiliate”) who refers customers to use product or service from the merchant.
By participating in the Program, Affiliate agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Affiliate or participate in the Program in any manner.
Approve or Reject of the Registration
We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.
Affiliate Links and Coupon
Affiliate link is automatically generated, but you can also generate an affiliate link for a specific product or collection. If a person clicks on someone else’s referral link and then later they click on yours, yours is the one that counts.
Affiliate might or might not be assigned to one coupon code, with details and usage clarified on their dashboard. If customer both click on the affiliate link and use coupon code, you will not receive a double commission. If you’re not assigned a branded coupon, then you’re not allowed to promote the coupon.
Affiliate may also advertise merchant website on online channels such as Facebook, Instagram,... or offline classified channel ads, magazines, and newspapers.
Commissions and payment
Refer any customer to make a purchase on our website, you will get a commission amount which is calculated based on Commission structure. Commission amount is dependent on your specific program, order value and does not including extra fee (tax, shipping cost,...).
For an Affiliate to receive a commission, you need to specify the payment details on Settings. Payment schedule will be notified on Affiliate Guide page. No commission payment will be made if the affiliate does not have an active payment method.
Payments will only be sent for transactions that have been successfully completed and tracked via our cookie-based tracking system. Use of the Affiliate Program is subject to a fair use policy which gives merchant the right to review each and every referral order. Status of commission if displayed in Commission tab, any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out.
Marketing tools
We may share promotion media such as banner, logo or specific collection promotion to you through Marketing tool tab. You can download the media or get the HTML embed code in order to share on affiliate channels.
Network
If Network tab is activated, affiliate can invite others to become their downline affiliate. If any downline affiliate brings order to merchant shop, upline affiliate will also get network commission which depends on merchant settings.
To invite other affiliates into the system, share network link and any other affiliate who click on that link and sign up will become a downline affiliate.
Cookies
We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.
If a person doesn't allow cookies or clears their cookies then we can't track them so can't pay earnings on that person's activity.
Cookies day is said on the Affiliate registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or use the coupon. Within the cookie time, every order made by this customer at merchant website will automatically result in commissions to the affiliate (There’s no need for the customer to click on the affiliate link then).
Removal from Referral Program
If an affiliate wishes to be removed from the Affiliate Program, they can do so by contacting: hello@cravejmos.com
User Requirements
To participate in our Affiliate Program, users must meet certain age and ownership criteria. All users must be at least 18 years of age to join. If users are under 18, their Affiliate Account must be registered and operated by their parent or legal guardian.
Additionally, to receive commissions, users must link their Affiliate Account to a PayPal account that is owned and managed by their parent or legal guardian. This PayPal account must also comply with the terms and conditions set by PayPal. Failure to adhere to these requirements may result in the immediate cancellation of the Affiliate Account. These requirements are put in place to ensure legal compliance and financial responsibility within our affiliate program.
Termination Clause
Either party (the Affiliate or the Merchant) reserves the right to terminate this Affiliate Agreement under the following circumstances:
- Violation of any terms and conditions outlined herein.
- Engaging in unethical or fraudulent marketing practices.
- Failure to comply with the Merchant's branding and intellectual property guidelines.
- Engaging in activities that directly compete with the Merchant's products or services during the Affiliate's participation in the Affiliate Program.
- Any other valid reasons as determined by the Merchant.
Intellectual Property
Affiliates are granted limited, non-exclusive rights to use the Merchant's branding, trademarks, and intellectual property solely for the purpose of promoting our products and services. Affiliates must adhere to the Merchant's guidelines on the use of logos, images, and content, ensuring that they do not misrepresent the brand in any way.
Reporting and Analytics
Affiliates will have access to performance reports and commission tracking through our platform. These reports will be made available on a regular basis and will include relevant information regarding their promotional activities and earnings.
Liability and Indemnification
Both the Merchant and Affiliates agree to limit their liability to the fullest extent permitted by law. In the event of any dispute, claim, or legal action arising from the Affiliate's promotional activities, the Affiliate agrees to indemnify and hold the Merchant harmless from any resulting damages or legal fees.
Changes to Terms
The Merchant reserves the right to modify these terms and conditions. Affiliates will be notified of any significant changes in advance. Continued participation in the Affiliate Program after the modifications constitute acceptance of the revised terms.
Dispute Resolution
In the event of a dispute, both parties agree to engage in good faith negotiations to resolve the matter. If resolution cannot be achieved through negotiation, the parties agree to mediation or arbitration in accordance with the laws of the State of Illinois.
Non-Compete and Non-Disclosure
During the term of this agreement, Affiliates are prohibited from promoting products or services that directly compete with the Merchant's offerings. Additionally, Affiliates shall maintain strict confidentiality regarding any sensitive business information shared by the Merchant.
Customer Data Handling
If Affiliates have access to customer data, they are responsible for handling it in compliance with all applicable laws, including data protection and privacy regulations such as GDPR or CCPA.
Customer Support
The Merchant will provide customer support for referrals generated through the Affiliate Program. Affiliates are not responsible for addressing customer inquiries or issues related to product or service orders.
Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Illinois. Any legal actions or disputes arising from this agreement shall be subject to the exclusive jurisdiction of the state and federal courts located within the State of Illinois.
Anti-Spam and Ethical Marketing
Affiliates are required to engage in ethical marketing practices and must refrain from spamming, deceptive advertising, or any activities that could damage the reputation of the Merchant.
Promotional Restrictions
Affiliates are prohibited from using promotional methods or channels that are not allowed by the Merchant, including but not limited to content related to adult material, gambling, or illegal activities.
